Senate Bill 1394 Summary

• Tampering with a voting machine or vote tally system becomes a felony offense under Idaho Code Section 18-2306.

• Requires each county clerk to conduct a public logic and accuracy test prior to election day to verify that vote tally systems accurately read and tabulate votes, with public notice published at least 10 days in advance.

• Revises voting machine and vote tally system definitions and requirements, including prohibiting wireless communications and internet connections to vote tally systems except for authorized electronic poll books.

• Directs voting machines and vote tally systems to be tested and certified by an independent testing authority designated by the Secretary of State prior to Secretary of State certification, and updates references to United States election assistance commission guidelines instead of federal election commission standards.

• Effective date of July 1, 2024, with emergency declaration.
