Adds new definition of "flow control" to mean any method by which a governmental entity compels solid waste haulers to use a designated facility, and renumbers existing definitions in Section 31-4401A.

Prohibits county commissioners and public authorities from using compulsory means, including flow control, to limit private sector competition in solid waste disposal pursuant to the U.S. Constitution.

Clarifies that county commissioners may determine whether solid waste services are provided through contract or otherwise, with or without competitive bidding, while maintaining prohibitions on flow control.

Revises Section 31-4407A to require counties proposing new solid waste processing facilities to provide notice to municipalities at least 180 days before construction, including a feasibility study addressing estimated capital costs, operational costs, and facility lifespan.

Declares an emergency and makes the act effective July 1, 2024.
