Possession of marijuana in amounts of 3 ounces or less by persons 18 years or older is a misdemeanor with a mandatory minimum fine of $300, in addition to existing penalties for schedule I-VI controlled substance possession (up to 1 year jail and $1,000 fine)

Possession of marijuana greater than 3 ounces remains a felony punishable by up to 5 years imprisonment and up to $10,000 fine

The bill adds specific penalty language for small-quantity marijuana possession that did not previously exist in Idaho Code Section 37-2732

Declared an emergency measure with an effective date of July 1, 2025
