Creates state crime of "illegal entry from foreign nation" for aliens entering Idaho directly from a foreign country at locations other than lawful ports of entry; first offense is a misdemeanor, second or subsequent offense is a felony

Establishes crime of "illegal reentry" for aliens who enter or are found in Idaho after being previously deported, excluded, or removed from the United States; generally a misdemeanor but elevated to felony in certain circumstances involving prior drug or violent crime convictions

Authorizes magistrates and judges to issue orders requiring aliens charged with or convicted of these offenses to return to the foreign nation from which they entered, with refusal to comply constituting a felony

Provides civil immunity for state and local government officials, employees, and contractors enforcing these provisions; local government indemnification capped at $100,000 per person/$300,000 per occurrence for personal injury, while state indemnification has no cap

Declares an emergency, making the law effective immediately upon passage and approval; includes affirmative defenses for those with lawful presence, asylum status, or DACA approval between June 15, 2012 and July 16, 2021
