Recreation clubs (nonprofit corporations and unincorporated associations) and their unpaid members, officers, directors, and volunteers are shielded from liability for injuries or deaths of participants in free recreation activities such as hunting, fishing, hiking, boating, camping, and winter sports

Liability protection does not apply when equipment provided by the club or member directly causes injury, when a member acts with gross negligence or intentional harm, or when a member fails to exercise ordinary care in their own participation

Clubs and members have no duty to eliminate or reduce inherent risks of recreation activities, and participants assume all risks inherent in the activity

Participants may sign written waivers prospectively releasing negligence claims against clubs and members, which Idaho declares enforceable as state policy

Effective July 1, 2025 under emergency declaration
