Creates state criminal offense for unlawful entry into Idaho by non-citizens, with first offense as misdemeanor and subsequent offenses as felonies; enforcement limited to situations where person is already detained for another crime under Title 18 or drug offenses

Establishes felony crime of "trafficking a dangerous illegal alien" punishable by 1-2 years imprisonment and up to $10,000 fine for knowingly transporting into Idaho an undocumented person with prior felony convictions

Requires custodial authorities to comply with federal immigration detainers and notify DHS within 48 hours when a suspected foreign national is arrested; prohibits release of convicted undocumented individuals until DHS confirms it will take custody

Imposes mandatory minimum 5-year sentence enhancement for any person 18+ convicted of a felony who has previously been deported or is under deportation order

Provides affirmative defenses for those granted lawful presence, asylum, or DACA approval (between June 15, 2012 and July 16, 2021), and grants immunity to law enforcement acting in good faith under the chapter
