Non-U.S. citizens are prohibited from voting in all public elections in Idaho, including primary, general, federal, state, and local elections, as well as votes on constitutional amendments, ballot initiatives, and referenda

Secretary of State must verify citizenship status of all registered voters by cross-referencing the statewide voter registration list with Idaho Transportation Department records, Social Security Administration's HAVA verification system, and other available databases

Registered voters whose U.S. citizenship cannot be confirmed through database checks will be removed from eligible voter rolls and notified in writing, with an opportunity to provide documentary proof of citizenship for reinstatement

Starting July 1, 2025, all new voter registration applications must have citizenship status confirmed through database verification before being added to registration lists

Willful violations constitute the crime of attempting to vote when not qualified under Section 18-2307, Idaho Code; declared an emergency measure effective July 1, 2025
