County commissioners may enact "flow control" measures requiring solid waste haulers to use designated facilities to protect public investment, reduce liabilities, prevent underutilized publicly-funded assets, ensure environmental compliance, and promote public health.

Counties must complete an independent professional study before enacting flow control, including financial impact analysis, cost-benefit comparison, liability evaluation, compliance verification, environmental assessment, and review of alternatives.

Counties that are members of regional solid waste or domestic septage disposal districts under Chapter 49, Title 31 are exempt from the independent study requirement.

The study must be presented at a public forum with adequate notice before any flow control decision, allowing citizens to review findings and provide input.

Declares an emergency with an effective date of July 1, 2025.
