Foreign governments and state-controlled enterprises are prohibited from acquiring controlling interests in agricultural land, forest land, water rights, mining claims, or mineral rights in Idaho, with exemptions for holdings acquired before the effective date and foreign pension funds.

Foreign principals from designated foreign adversaries (China, Cuba, Iran, North Korea, Russia, and the Maduro regime of Venezuela) are banned from holding any controlling interest in agricultural land, water rights, mining claims, or mineral rights statewide.

Foreign adversary principals are prohibited from purchasing, renting, or controlling any property within a specified geographic zone in southern Idaho (coordinates roughly covering areas near military installations), with existing owners required to divest within 180 days.

Foreign principals must register agricultural land holdings with the Idaho Department of Agriculture and mining claims/mineral rights with the Idaho Department of Lands and Secretary of State within 60 days of the effective date or acquisition.

Whistleblowers who report violations resulting in forced divestiture are entitled to 30% of sale proceeds after lienholders and costs are paid, with enforcement provisions taking effect 180 days after July 1, 2025.
