Public institutions of higher education in Idaho are prohibited from creating "free speech zones" that restrict non-commercial protected expressive activities to designated outdoor areas of campus

Security fees cannot be charged to students or student organizations based on the content of their expression or anticipated reactions to invited speakers' expression

Students and student organizations may sue institutions for violations, with courts authorized to award injunctive relief, compensatory damages up to $25,000, nominal damages, court costs, and attorney's fees

Each public institution must submit a report on its free speech implementation policies to the governor and legislative services office by December 1, 2025, and publish free speech policies in handbooks, websites, and orientation programs

The act takes effect July 1, 2025, and includes a 1-year statute of limitations for filing suit, with each day a violation persists constituting a new accrual date
