Idaho Department of Health and Welfare must publish an illegal electronic smoking device brand list by July 1, 2025, including brands subject to FDA warning letters, import alerts, seizure orders, or federal complaints for being adulterated or misbranded

Sales of listed brands prohibited beginning September 1, 2025, or 60 days after the list is published, whichever is later; sellers have 60 days to remove products after new brands are added to the list

Penalties include $5,000 fines per violation, with escalating permit suspensions (7 days for second offense, 30 days for third, 1 year for fourth) and permit revocation for fifth violation within a two-year period

Products on the illegal list are declared contraband and subject to warrantless seizure; retailers, distributors, and wholesalers must undergo at least two unannounced compliance checks annually
