Governor may only declare a disaster emergency if he has first convened a special session of the legislature by proclamation under the Idaho Constitution, and the stated purpose of that special session must include the disaster emergency matter.

Disaster emergency declarations are limited to 30-day periods, with the governor permitted to extend for another 30 days, but cannot continue beyond 60 days total from the original declaration date.

Emergency orders must be essential to protect life or property and narrowly tailored to avoid unnecessary restrictions on people's ability to work, provide for families, or contribute to the economy regardless of job type.

Legislature retains authority to terminate any state of disaster emergency at any time by concurrent resolution.

Act takes effect July 1, 2025.
