Requires all governing boards to mandate conditional use permits for construction of any energy facility as defined in Idaho Code section 67-2352

Each permit must include a condition requiring the energy facility to offer electricity for purchase first to electric suppliers serving Idaho consumers before offering to out-of-state suppliers

Electricity must be offered to Idaho-serving suppliers at the market price existing at the time of the offer

Any conditional use permit granted without complying with these requirements is void

Provisions expire July 1, 2030, with the act taking effect July 1, 2025 under emergency declaration
