All private construction contracts in Idaho, including those involving original contractors, subcontractors, and material/equipment suppliers, must be subject to Idaho law

Construction contracts cannot require litigation, arbitration, or other dispute resolution processes to occur in another state or country

Existing retention payment limits remain unchanged: owners and contractors may withhold no more than 5% of payments from contractors/subcontractors

Retention must be reduced within 35 days of substantial completion and released within 35 days of final completion, with provisions allowing withholding of up to 150% of disputed amounts

Declared an emergency measure with an effective date of July 1, 2025
