School districts with 400 or fewer students may employ a trustee's spouse in nonadministrative positions through June 30, 2030, provided the trustee abstains from all hiring, employment, and compensation decisions

Trustees must abstain from voting and be absent from meetings when decisions involve their spouse's compensation, benefits, performance evaluations, or disciplinary actions

Spouses of trustees employed as certificated employees must be hired under category 1 contracts, while noncertificated spouses must be employed as at-will employees with no contract rights

Existing provisions remain for districts with 1,200 or fewer students, requiring positions to be publicly posted for 60 days (or 15 days for mid-year openings) with no other qualified applicants before a spouse can be hired

Declared an emergency measure with an effective date of July 1, 2025
