Peace Officer Standards and Training Council must reject certification applicants convicted of any felony enumerated in Idaho Code section 18-310(2) or substantially equivalent offenses from other jurisdictions, where the punishment could have been imprisonment in a federal or state penal institution

Council may reject applicants convicted of felonies that have been set aside, expunged, pardoned, reduced to a misdemeanor, dismissed under section 19-2604, or subject to withheld judgment

"Convicted" is defined broadly to include any plea or finding of guilt regardless of whether the sentence is imposed, suspended, deferred, or withheld, and regardless of subsequent dismissals or reductions based on rehabilitation rather than legal defects

Declared an emergency measure with an effective date of July 1, 2025
