Abatement districts must obtain annual written permission from landowners before entering or flying above their property for any abatement-related activities, including treatment, monitoring, and surveillance, even during declared emergencies.

Property owners within abatement districts may submit written notice to county commissioners to permanently exempt their property from all abatement activities; the exemption remains in effect until rescinded in writing.

Aerial abatement methods may only be used when county commissioners have declared an emergency, and exempted properties must be excluded from aerial treatment.

Violations of a property exemption subject the board of county commissioners to a $5,000 fine per violation paid to the property owner, plus reasonable attorney's fees and costs.

The bill takes effect immediately upon passage as emergency legislation and removes the previous provision allowing districts to enter any and all lands for mosquito and vermin control.
