Amends Idaho Code 18-4506 to establish a graduated penalty structure for child custody interference: first offense $100 infraction, second offense $300 infraction, third/fourth offense misdemeanor with up to $1,000 fine and 2 days imprisonment, fifth and subsequent offenses felony with up to $5,000 fine and 1 year imprisonment.

Requires law enforcement officers responding to custody interference reports to verify the child's location, check the child's safety and well-being, and complete a written offense report documenting the date, time, location, child's physical condition, and relevant statements.

Adds a new affirmative defense for temporary delays in custody compliance when circumstances beyond the charged party's control made timely compliance impracticable, provided the party notified the other parent, minimized interference, and resumed compliance at the earliest feasible time.

Removes the previous 24-hour grace period defense for returning a child after authorized visitation expires.

Declares an emergency with an effective date of July 1, 2026.
