Amends Idaho Code Section 6-310A regarding the removal of unauthorized persons from residential real property by changing the sheriff's service fee reference from a "writ of possession" to a "writ of restitution"

Property owners may request immediate sheriff removal of unlawful occupants from residential dwellings through a verified complaint process, provided specific conditions are met (no tenant relationship, no pending litigation, not family members, etc.)

Sheriffs must verify property ownership, serve notice to vacate without delay, and may arrest occupants for trespass or other crimes; property owners may request sheriff standby assistance while changing locks and removing occupants' belongings

Persons wrongfully removed may bring civil action to recover actual damages, statutory damages equal to triple fair market rent, court costs, and attorney's fees

Declared an emergency measure with effective date of July 1, 2026
