Employers, employment agents, recruiters, and labor organization representatives who knowingly employ, rehire, recruit, or refer unauthorized aliens for employment in Idaho commit a misdemeanor

An alien is considered unauthorized for employment if not lawfully present in the U.S., lacks valid federal immigration status authorizing work, or holds expired/terminated/revoked employment authorization

Employers who know or reasonably should know an employee's immigration status or work authorization has expired or been revoked must not continue employing that person

Employers who verify identity and employment eligibility through the federal E-Verify program before hiring, and receive confirmation of authorization, are shielded from criminal liability

Declared an emergency measure with an effective date of July 1, 2026
