Qualifying public charter schools (non-virtual, meeting specific performance requirements under section 33-5218) may spend state funding—including discretionary, categorical, and salary apportionment funds—however they determine best serves students, without amending their charter or performance certificate.

State funding for participating schools is calculated based on prior-year per-pupil funding, adjusted for statewide education funding changes and enrollment changes.

Participating charter schools are exempt from various reporting requirements under multiple Idaho Code sections without penalty or funding reduction.

The State Department of Education may revoke eligibility if a school fails to receive an unmodified audit opinion, has material audit weaknesses, fails academic requirements for two or more years, or has its charter revoked or conditionally renewed.

The State Board of Education must report to the legislature in 2029 on participation numbers and any changes in student growth or proficiency on state achievement tests; the bill takes effect July 1, 2026.
