Landowners whose property is annexed without their voluntary consent cannot be required to use city wastewater and water services and may maintain or replace existing compliant wastewater and water systems.

Cities must pay any costs incurred by non-consenting landowners when city construction, installation, or modification of municipal infrastructure causes the failure of the landowner's existing wastewater or water systems.

Annexation requires consent from landowners representing 60% of parcels and at least 50% of the area proposed for annexation, with written consent recorded at the county recorder's office.
