Only naturally derived cannabidiol (CBD) is permitted in consumable or personal use hemp products in Idaho; all other cannabinoids, whether natural or synthetic, are prohibited

Retail stores selling hemp products must obtain an annual license from the Idaho Department of Agriculture for $600, with a $25 fee for each additional location under the same owner

The Department may conduct compliance inspections and collect product samples for testing, with licensees bearing all testing costs and having 5 days to request a retest

Violations may result in civil penalties up to $10,000 per offense plus attorney's fees, with violators entitled to notice and a hearing under the Idaho Administrative Procedure Act

Declared an emergency measure, the law takes effect July 1, 2026
