Removes the residency requirement that previously required nonpublic or public school students to live within attendance boundaries of the school where they participate in nonacademic activities

Grants all eligible nonpublic students access to participate in all nonacademic public school activities, including both extracurricular and cocurricular activities

Authorizes school districts and public charter schools to charge fees to nonpublic students for participation in nonacademic activities, with fees reflecting the actual costs of participation

Shifts academic eligibility oversight from state board of education rules to the student's primary education provider for determining appropriate achievement tests, portfolios, or other mechanisms

Declares an emergency and sets an effective date of July 1, 2026
