Candidates for Idaho state representative or senator must maintain a "fixed habitation" within their legislative district for one year immediately preceding their declaration of candidacy filing date.

"Fixed habitation" requires actual physical presence and occupancy at the residence for at least 120 nights during the one-year period before filing.

Exemptions to the fixed habitation requirement are provided for candidates on active military service or religious missions during the one-year period.

Existing requirements retained: candidates must be 21 years old, U.S. citizens, and registered electors in the district for one year preceding the general election.

Effective date: January 1, 2027.
