Attendees of open public meetings cannot be prevented from recording meetings, including audio, video, or photographs by electronic, digital, or other means.

Governing bodies may take measures to ensure orderly conduct but cannot prohibit or unreasonably restrict recording, and no person may be removed or excluded for recording.

Recording protections do not apply to executive sessions, meetings at Idaho Department of Correction facilities, Idaho Department of Juvenile Corrections facilities, or Idaho Commission of Pardons and Parole hearings.

Declared an emergency measure with an effective date of July 1, 2026.
