Data centers beginning construction on or after July 1, 2026, are prohibited from using water for cooling purposes as a consumptive use, unless supplied by a municipal, water district, or water and sewer district system

Legislature declares that water use by data centers conflicts with local public interest, is contrary to conservation of water resources, and will adversely affect local economies when water is transferred outside originating watersheds

Director of the Department of Water Resources must consider these legislative findings when evaluating new water appropriations or transfers for data centers

Declared an emergency measure, taking effect July 1, 2026
