Photographs or images of a decedent taken during coroner death investigations or law enforcement investigations are exempt from public disclosure, regardless of whether the investigation is active or closed

Next of kin may request disclosure of such photographs once the coroner investigation, law enforcement investigation, criminal case (including appeals), and all related civil proceedings are no longer active

"Next of kin" is defined as the closest living relative in priority order: spouse, adult children, parents, siblings, and grandparents

Amends Idaho Code Section 74-105, which governs records exempt from public disclosure

Declared an emergency measure with an effective date of July 1, 2026
