State agencies must report all executed MOUs, MOAs, and agreements to the state controller within 10 business days of execution, including document title, dates, participating entities, purpose, contact information, and monetary value.

Agencies must annually review and certify the accuracy of reported agreements by January 1, with certification signed by the agency head or authorized representative.

Noncompliant agencies receive written notice and have 30 days to cure the violation, with possible extension to 60 days; the state controller reports persistent noncompliance to the legislative services office by January 5 annually.

Agencies that remain noncompliant may face budgetary holdbacks the following fiscal year at the discretion of the Joint Finance-Appropriations Committee, subject to legislative and gubernatorial approval.

Effective July 1, 2026, under emergency declaration.
