Governor prohibited from authorizing Idaho's organized militia to enter active duty combat unless Congress has passed an official declaration of war or explicitly called forth the Idaho National Guard under Article I, Section 8, Clause 15 of the U.S. Constitution

"Active duty combat" defined as participation in armed conflict, performance of hazardous service related to armed conflict in a foreign state, or duty through an instrumentality of war

Non-combat federal service remains unaffected, including training, administrative duty, and defense support for civil authorities missions within the U.S. and its territories

Militia members may continue serving under 32 U.S.C. 101 et seq. duty status regardless of this restriction

Declared an emergency measure, taking effect immediately upon passage and approval
