Supreme Court justices, Court of Appeals judges, and district judges who file candidacy after July 1, 2026 to run for another term and then retire before completing that term become ineligible to serve as senior judges and cannot elect the enhanced retirement compensation under subsection (2)(b)

Judicial candidates standing for election must provide written acknowledgment to the Supreme Court confirming awareness of these retirement benefit restrictions

Exceptions apply for judges who gave written retirement notice and elected subsection (2)(b) compensation prior to July 1, 2026, or who retire early due to illness or incapacitation preventing performance of duties

Legislative intent is to encourage judges to complete their elected terms, promoting the constitutional principle that Idaho citizens elect their judges rather than having replacements appointed mid-term

Declared an emergency measure with effective date of July 1, 2026
