HB0158 Summary

• Amends the Plat Act to allow vacation of plats by designated officers in addition to city councils, village boards, or county boards when public service facilities exist in public ways and easements shown on the plat.

• Permits partial vacation of plats subject to approval by the city council, village board, county board, or their designated officer or officers under the same conditions as full plat vacations.

• Requires that partial plat vacations cannot abridge or destroy the rights or privileges of other property owners in the plat or the owner of the portion being vacated.

• Maintains existing protections that plat vacation instruments must reserve property rights and easements necessary for public bodies and utilities to continue service and maintain their facilities.

• Takes effect immediately upon becoming law.
