HB0183 Summary

• Prohibits recyclable metal dealers from acquiring or processing vehicles, junk vehicles, vehicle cowls, or essential vehicle parts unless they are also licensed as a scrap processor.

• Requires scrap processors to obtain and maintain documentary proof of ownership (Certificate of Title, Salvage Certificate, or Junking Certificate) for all vehicles and junk vehicles acquired, and to record specific information on weight tickets.

• Mandates scrap processors report to the Secretary of State any nonconforming vehicle identification numbers found on documentary proof of ownership, with violations subject to license suspension up to 5 years and Class 2 felony charges.

• Prohibits scrap processors from using the Secretary of State Uniform Invoice for any purpose, with violations constituting a Class 2 felony.

• Increases penalties for failing to record required information or maintain proper documentation from a fine not to exceed $1,000 to license suspension up to 5 years, and makes a second violation within two years a Class 4 felony.
