• Prohibits dentists, physicians, nurses with prescriptive authority, optometrists, pharmacists, physician assistants, and podiatrists from being compelled to release prescription records to wholesale drug distributors or pharmaceutical sales companies.

• Requires healthcare licensees to obtain a patient release waiver before releasing any prescription records to drug wholesalers or pharmaceutical sales entities.

• Allows healthcare licensees to take all necessary measures deemed acceptable by the Department to safeguard prescription records from unwanted release.

• Prohibits wholesale drug distributors from compelling prescribing agents to release prescription records and from receiving prescription records without proof of a patient-signed release waiver.

• Most provisions are scheduled to expire between January 1, 2013 and January 1, 2018.
