Municipalities and counties may adopt ordinances to aggregate residential and small commercial retail electrical loads and negotiate electricity purchase agreements on behalf of their constituents.

Opt-out aggregation programs require a referendum approved by a majority of electors; if the referendum fails, the jurisdiction must operate an opt-in program instead.

Municipalities and counties can exercise aggregation authority jointly with other municipalities or counties through majority vote approval by each corporate authority or county board.

Electric utilities must provide customer names and addresses in electronic format to requesting municipalities or counties, subject to existing privacy protections, with utilities exempt from liability for providing such information.

In opt-out programs, aggregators must fully inform customers of their right to opt out and provide clear disclosure of all charges and service options; the Illinois Power Agency must assist jurisdictions with planning and bidding processes.
