HB0728 - Calling Card Consumer Protection Act

• Creates the Calling Card Consumer Protection Act to regulate prepaid telephone calling cards and services, establishing consumer protections against fraudulent and deceptive practices in the industry.

• Requires prepaid calling card providers and distributors to disclose the total value or minutes available, all terms and conditions (including fees, limitations, and expiration policies), provider name, and customer service contact information on cards, packaging, advertising, and promotional materials in plain English and any other language used prominently on marketing.

• Prohibits providers from assessing undisclosed fees or charges, delivering fewer minutes than advertised, charging for unconnected calls, or setting expiration dates less than 1 year from first use (or 1 year from last purchase of additional minutes if the card allows recharging).

• Establishes that prepaid calling cards must be displayed with conspicuous time limitations on advertised minutes and prohibits disclaimers from avoiding liability for providing fewer minutes than promoted.

• Designates violations of the act as unlawful practices under the Consumer Fraud and Deceptive Business Practices Act, making them subject to enforcement and penalties; effective immediately upon enactment.
