HB0975 - Organized Crime Control Act

• Creates the Organized Crime Control Act defining "racketeering activity" as criminal conduct specified in federal law or Illinois felonies including drug offenses, fraud, and organized crime statutes, with "pattern of racketeering activity" requiring at least 3 related incidents within 7 years.

• Prohibits persons from using proceeds from racketeering activity to invest in real property or enterprises, acquiring/maintaining interests in enterprises through racketeering, or conducting enterprise activities through patterns of racketeering.

• Makes violations of the prohibited activities Class 1 felonies, with fines up to 2 times the gross value gained or gross loss caused, whichever is greater, plus court costs and investigation expenses.

• Requires mandatory criminal forfeiture of all real or personal property used in, intended for use in, or derived from racketeering violations, with injured persons having superior claims to forfeited property ahead of State claims.

• Establishes civil remedies including injunctive relief, business dissolution or reorganization, license revocation, and private civil actions for 2 times actual damages plus punitive damages and attorney's fees; gives Attorney General and State's Attorneys concurrent criminal prosecution authority.
