Illinois Pollution Control Board shall adopt regulations establishing permit programs for Prevention of Significant Deterioration (PSD) and Non-Attainment New Source Review (NSR) under the federal Clean Air Act Sections 165 and 173.

State permit programs must satisfy and be no more stringent than federal requirements under 40 C.F.R. 51.165 and 51.166.

Federal Clean Air Act provisions regarding standards of performance for new stationary sources (Section 111) and national emission standards for hazardous air pollutants (Section 112) are made applicable and enforceable in Illinois.

No person shall construct, install, modify, or operate equipment or facilities subject to federal Clean Air Act regulation without compliance with federal requirements and without obtaining a permit from the Agency.

Permit denial or conditions are subject to review by the Pollution Control Board; bill takes effect immediately upon becoming law.
