HB1054 - State Facility Overtime Act

• Prohibits directors of specified State facilities from requiring employees to work more than an agreed upon, predetermined, regularly scheduled daily shift not exceeding 40 hours per week

• Applies to Department of Human Services residential facilities (mental health hospitals, developmental centers, schools for deaf and visually impaired), Department of Veterans Affairs homes, Department of Corrections facilities, and Department of Juvenile Justice facilities that operate 24 hours daily

• Requires any overtime work beyond the regular schedule to be strictly voluntary, with employees protected from discrimination, dismissal, or adverse employment actions for refusing overtime

• Suspends the overtime ban during declared national or State emergencies, disasters, or catastrophic events that substantially increase the need for State services

• Directs the Illinois Department of Labor to investigate employee complaints and adopt administrative rules for enforcement, with authority to make affected employees whole if violations are found
