Local liquor control commissions gain the power to issue smoking licenses to eligible establishments including bars deriving less than 10% revenue from food sales, gambling venues, adult entertainment venues, private clubs with three-fifths member approval, and tobacco convention/exposition venues.

Eligible establishments seeking a smoking license must document that they disclosed to all employees that smoking will be permitted if the license is granted and that all employees acknowledged receipt of this disclosure.

Establishments with existing liquor licenses must remain in full compliance with all liquor license terms to qualify for a smoking license.

The Smoke Free Illinois Act is amended to allow smoking in any eligible establishment that obtains a smoking license from the local liquor control commission, provided the establishment posts prominent signage designating it as a smoking establishment.

The bill takes effect immediately upon becoming law.
