HB1306 Summary

• Amends the Local Government Energy Conservation Act to prohibit consultants, architects, engineers, and specification drafters from submitting bids on projects they helped design, unless the authorizing body determines in writing that no substantial conflict of interest exists and publishes this notice in the Illinois Procurement Bulletin.

• Modifies the School Code to require requests for energy conservation proposals be submitted to administrators of all 4 volumes of the Illinois Procurement Bulletin for publication in each bulletin, rather than just announced in one bulletin.

• Changes School Code language from "resolution" to "official action" for authorizing contracts and adds language clarifying that procurement authority under these sections is in addition to other authority granted by law.

• Updates the Public University Energy Conservation Act with identical changes to the School Code amendments, including the "official action" language change and clarification that authority is supplemental to other granted powers.

• Permits school districts, area vocational centers, and public universities to enter into installment payment contracts and lease purchase agreements with qualified providers or third parties for funding and financing energy conservation measures.
