IL HB1317

Amends the Criminal Code of 1961 to add a new offense (subsection a-7) for indecent solicitation of a child when committed using computers, online services, internet services, bulletin board services, or other electronic data transmission devices while misrepresenting age to the child.

Increases the felony classification by one level for violations committed using electronic devices: Class X felony (instead of Class 1) for predatory or aggravated criminal sexual assault; Class 1 felony (instead of Class 2) for criminal sexual assault; Class 2 felony (instead of Class 3) for aggravated criminal sexual abuse.

Maintains existing penalties for traditional indecent solicitation of a child under subsection (a) and adds a Class 4 felony penalty for internet-based discussions of sexual conduct under subsection (a-5).

Provides that it is not a defense under subsection (a-5) that the person did not solicit the child to perform sexual conduct with the perpetrator specifically.

Defines key terms including "computer," "online," "internet," and "child" (person under 17 years of age) for purposes of the statute.
