IL HB1320

Amends the Harassing and Obscene Communications Act (720 ILCS 135/2) to increase penalties for violations involving threats to kill.

Creates a new Class 3 felony charge when a person violates harassment provisions and threatens to kill the victim or any member of the victim's family or household.

Removes the prior Class 4 felony provision (subsection (b)(4)) that previously applied this threat-to-kill circumstance, replacing it with the higher Class 3 felony classification in new subsection (c).

Maintains existing Class B misdemeanor penalties for first violations and Class A misdemeanor penalties for subsequent violations without death threats.

Maintains existing Class 4 felony penalties for violations involving three or more prior offenses, previous violations against the same victim, violations while under protective orders, prior forcible felony convictions, or offenses involving minors.
