IL HB1846

Amends the Smoke Free Illinois Act by adding gaming facilities licensed under the Riverboat Gambling Act as an exemption to smoking bans, provided smoking is not banned in gaming facilities in the nearest neighboring state.

The gaming facility exemption terminates on the date that smoking is banned in gaming facilities located in the nearest neighboring state.

Maintains existing exemptions for private residences, retail tobacco stores, hotel/motel smoking rooms (limited to 25% of rooms), enclosed laboratories, and common smoking rooms in long-term care facilities.

Retail tobacco stores operating prior to the effective date must file annual affidavits with the Department by January 31st reporting the percentage of gross income derived from tobacco and smoking-related products.

Takes effect upon becoming law.
