Applicants for public aid benefits under the Illinois Public Aid Code must pass a urine drug test as a condition of initial eligibility.

Recipients must pass a urine drug test at least once every 12 months at a random time designated by the Department of Human Services or Department of Healthcare and Family Services.

Recipients who test positive are thereafter ineligible for any benefits under the Code.

Six months after benefits termination due to a positive test, the department must notify the person they may retake the drug test and regain eligibility if they test negative.

The Act takes effect immediately upon becoming law.
