HB2434 - Green Infrastructure for Clean Water Act

• Creates the Green Infrastructure for Clean Water Act requiring the Illinois Environmental Protection Agency to adopt comprehensive storm water management rules by July 1, 2012 that establish performance standards for water quality, detention release rates, and groundwater recharge.

• Mandates a preference for green infrastructure best management practices (including rain gardens, permeable pavements, green roofs, trees, and wetland preservation) to comply with storm water performance standards.

• Requires the Agency to implement a storm water permit fee program beginning in 2010 to fund adoption and enforcement of storm water regulations and provide education and guidance for green infrastructure implementation.

• Directs the Agency to establish a statewide green infrastructure portfolio standard that gradually increases the percentage of annual storm water runoff managed through green infrastructure strategies.

• Requires the Agency to review Water Revolving Fund distribution rules and establish new criteria prioritizing green infrastructure in storm water management and water efficiency projects.
