HB2485 Summary

• Bans the sale and distribution of bisphenol A (BPA) in children's food containers (baby bottles and sippy cups designed for children 3 years or younger) and sports water bottles effective July 1, 2010, with an exemption for metal cans.

• Requires manufacturers to notify retailers at least 90 days before the effective date of restrictions and to recall prohibited products and reimburse purchasers; protects unknowing retailers from liability.

• Authorizes the Illinois Environmental Protection Agency and Illinois Department of Public Health to participate in an interstate clearinghouse to share data on chemical hazards, safer alternatives, and model policies.

• Designates the Attorney General as the enforcing authority with power to investigate violations, issue subpoenas, receive complaints, and seek injunctive relief and civil penalties up to $50,000 per violation.

• Creates the Attorney General's State Projects and Court Ordered Distribution Fund to receive civil penalties and settlement payments for use in law enforcement, product testing, and public education programs.
