HB2622 Summary - Nurse Assistant Certification Act

• Creates a certification requirement for all persons representing themselves as or working as certified nurse assistants in Illinois, effective July 1, 2010, or upon commencement of practice (whichever is later).

• Establishes the Illinois Department of Public Health as the certifying body and prohibits uncertified practice under penalty of up to $5,000 civil penalty per offense.

• Requires the Department to investigate all allegations of abuse or neglect of eligible adults (persons age 60+) by certified nurse assistants, whether occurring in facilities or domestic living arrangements.

• Mandates disciplinary action against certified nurse assistants found to have abused or neglected eligible adults following investigation.

• Requires the Department to establish rules defining disciplinary grounds and procedures, while ensuring certified nurse assistants receive full due process rights.
