• Establishes a standard one-time crossing fee of $1,500 per crossing for utilities, covering administrative and engineering costs, in lieu of other fees or permits.

• Utilities can locate facilities for communications, electricity, gas, water, and sewer services within railroad rights-of-way and gain authorization to begin crossing activities 30 days after payment and engineering specification completion.

• Requires non-binding arbitration if parties cannot agree that special circumstances exist, with potential escalation to binding arbitration under American Arbitration Association Commercial Rules if disputes remain unresolved after 30 days.

• Applies to new crossings and previously commenced crossings where agreements have expired or been terminated, effective immediately upon enactment.
