IL HB3855

Amends the Consumer Fraud and Deceptive Business Practice Act to require gas and service stations with automatic payment pumps to program devices so consumers must enter a zip code matching their card's billing information before payment is approved.

Limits automatic payment devices to 2 failed zip code entry attempts; after the second failure, the station must require the consumer to use a different payment method or card.

Exempts gas stations with motor fuel dispensing devices that lack automatic payment capability from these requirements and prohibits enforcement actions against such stations.

Classifies violations of this section as unlawful practices under the Consumer Fraud and Deceptive Business Practice Act.

Effective January 1, 2010.
